Website Terms of Use

PARADISE TUTORS LLC
WEBSITE TERMS OF USE

Effective Date: October 28, 2026
Last Updated: October 28, 2026

1. Introduction and Scope

These Website Terms of Use (“Website Terms”) govern access to and use of the website located at www.paradisetutorsnaples.com and any other websites expressly displaying these Website Terms (collectively, the “Website”). The Website is operated by Paradise Tutors LLC (“Company,” “we,” “us,” or “our”).

“You” and “your” refer to the individual accessing the Website or, where applicable, an organization on whose behalf that individual is authorized to act.

These Website Terms concern use of the Website. Tutoring, test preparation, college consulting, and other purchased services are governed by the separately accepted Client Services Terms, service descriptions, fee policies, and payment authorizations applicable to the engagement.

If these Website Terms conflict with a separately accepted services agreement concerning purchased services, the services agreement controls with respect to those services. These Website Terms do not modify an existing services agreement or independently authorize payment card charges.

Our Privacy Policy separately describes our personal information practices. It is a notice of those practices and is not a blanket consent to every form of data processing.

2. Acceptance and Eligibility

Where the Website requests your acceptance of these Website Terms, clicking an expressly labeled acceptance control or signing a form expressly incorporating these Website Terms constitutes your agreement to them.

Any other asserted acceptance through Website use is subject to applicable requirements concerning notice and assent. Merely placing these Website Terms on the Website does not establish that every visitor has agreed to every provision.

If you do not agree to these Website Terms, do not use features that require acceptance.

You must be at least eighteen years old, or otherwise have legal capacity under applicable law, to purchase services or enter into an agreement with Company. If you act for another person or organization, you represent that you have the authority necessary for the action you take.

A minor’s Website use does not, by itself, create an enforceable waiver of the minor’s rights or a payment obligation for a parent or guardian.

3. Website Information and Educational Content

The Website provides general information about Company, its services, and educational topics. Articles, worksheets, sample questions, explanations, admissions discussions, and other resources are provided for general educational and informational purposes.

Website content does not constitute individualized educational advice, legal advice, tax advice, investment advice, or financial-planning advice.

Although we endeavor to maintain useful and accurate information, content may contain errors, become outdated, or omit information relevant to your circumstances. Institutional requirements, testing policies, application procedures, deadlines, and financial-aid rules may change.

Verify current requirements directly with the relevant school, testing organization, application platform, or other authoritative source before making decisions or submitting materials.

Submitting an inquiry, accessing a resource, or receiving an automated acknowledgment does not, by itself, establish a tutoring or consulting engagement.

4. No Guarantee of Outcomes

Company does not guarantee any particular test score, score increase, grade, academic improvement, admission decision, scholarship, financial-aid award, or other educational or institutional outcome.

Descriptions of prior results, testimonials, case examples, goals, and anticipated improvements do not constitute a promise that another student will achieve comparable results.

Results depend on individual circumstances, student participation and preparation, and decisions or conditions outside Company’s control. Performance may improve, remain unchanged, or decline.

Nothing in this section excuses Company from performing expressly agreed services with reasonable care or limits rights that cannot lawfully be waived.

5. Intellectual Property

Except for materials owned by third parties or otherwise identified, Website content—including original text, graphics, designs, logos, worksheets, instructional materials, and the selection and arrangement of content—is owned by Company or its licensors and protected by applicable intellectual property laws.

Subject to these Website Terms, Company grants you a limited, nonexclusive, nontransferable permission to access the Website and use resources made available for download for your personal, noncommercial educational purposes, unless a resource expressly permits broader use.

Except as permitted by law or expressly authorized in writing, you may not reproduce, sell, license, redistribute, publicly display, republish, or commercially exploit Website content.

You may not remove copyright, trademark, or other proprietary notices.

No ownership rights are transferred to you. All rights not expressly granted are reserved. Nothing in these Website Terms restricts fair use or other rights that applicable law grants independently of Company’s permission.

6. Acceptable Use

You agree not to use the Website to:

(a) violate applicable law or another person’s rights;

(b) impersonate another person or misrepresent your identity, authority, or affiliation;

(c) submit fraudulent, defamatory, threatening, harassing, or unlawfully discriminatory material;

(d) upload malicious code or attempt unauthorized access to accounts, systems, or information;

(e) interfere with the Website’s operation, security, or availability;

(f) collect personal information about others without lawful authority;

(g) circumvent access restrictions or technical safeguards;

(h) conduct automated extraction or bulk collection that infringes rights, circumvents restrictions, or materially burdens the Website; or

(i) reproduce or exploit proprietary instructional materials for commercial redistribution or automated model training without permission, except where permitted by applicable law.

These restrictions do not prohibit lawful criticism, truthful reviews, protected reporting, or other legally protected conduct.

7. Information and Materials You Submit

You are responsible for the accuracy of information you submit and for having authority to provide it.

You retain ownership of essays, documents, messages, and other materials you submit. By submitting materials for an inquiry or requested service, you grant Company permission to access, reproduce, transmit, and use those materials only as reasonably necessary to respond to the inquiry, provide the requested service, administer the engagement, or comply with applicable law, consistent with our Privacy Policy.

Submission does not grant Company unrestricted ownership or an unrestricted right to publish your work.

Use of identifiable student materials, testimonials, or results in marketing requires separate appropriate permission.

Do not submit another person’s confidential information without authorization. Do not send sensitive financial, medical, or identity information through a general inquiry field unless specifically requested through an appropriate process.

8. Accounts and Access Credentials

If account features are available, you are responsible for providing accurate registration information, maintaining the confidentiality of your credentials, and promptly notifying us of suspected unauthorized access.

You may not knowingly permit unauthorized use of your account. Your responsibility for account activity is subject to applicable law and does not extend automatically to losses caused by Company’s own actionable conduct.

We may restrict access when reasonably necessary to address suspected fraud, security threats, unlawful conduct, or material violations of these Website Terms.

9. Inquiries, Scheduling, Prices, and Transactions

Descriptions of services and availability on the Website are informational and do not guarantee that a particular appointment, tutor, rate, or service will be available.

An inquiry or scheduling request is not confirmed until Company expressly accepts it. Applicable rates, cancellation policies, payment obligations, and other engagement terms must be disclosed and accepted through the relevant enrollment or purchasing process.

We may correct clerical, pricing, or descriptive errors. A correction does not automatically alter a previously accepted agreement or permit an unauthorized charge. If a correction affects an existing transaction, we will address it with the purchaser in accordance with the agreement and applicable law.

10. Third-Party Websites and Services

The Website may link to or incorporate third-party websites, payment services, scheduling tools, social platforms, videos, or other resources.

Third-party services may have their own terms and privacy practices. A link or reference does not, by itself, constitute endorsement, sponsorship, or a guarantee of third-party content or performance.

Company does not control third-party systems and is not responsible for their independent acts or omissions, except to the extent applicable law imposes responsibility on Company or Company’s own actionable conduct contributes to a loss.

11. Trademarks and Institutional References

Third-party names, trademarks, and logos belong to their respective owners. References to tests, schools, application platforms, and other organizations are for identification and informational purposes.

No affiliation, sponsorship, endorsement, or approval should be inferred unless expressly stated and supported by an actual relationship.

12. Website Availability and Changes

We may update, replace, suspend, or discontinue Website features for maintenance, security, operational, or other legitimate reasons.

We do not guarantee uninterrupted access or that the Website will operate without errors. Changes to the Website do not eliminate obligations under an existing services agreement or any refund or other remedy required by law.

13. Website Warranty Disclaimer

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS GENERAL INFORMATIONAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

COMPANY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT TO THE EXTENT SUCH DISCLAIMERS ARE LAWFUL.

COMPANY DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, OR FREE OF TECHNICAL ERRORS OR HARMFUL COMPONENTS.

THIS DISCLAIMER DOES NOT OVERRIDE EXPRESS COMMITMENTS IN A SEPARATELY ACCEPTED SERVICES AGREEMENT, EXCUSE FRAUD OR OTHER NONWAIVABLE MISCONDUCT, OR LIMIT WARRANTIES OR REMEDIES THAT APPLICABLE LAW DOES NOT PERMIT TO BE DISCLAIMED.

14. Limits on Website-Related Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, COMPANY AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS ACTING WITHIN THE SCOPE OF THEIR DUTIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF, OR INABILITY TO USE, THE WEBSITE.

THIS PROVISION CONCERNS WEBSITE USE. LIABILITY RELATING TO PURCHASED SERVICES IS GOVERNED BY THE APPLICABLE SERVICES AGREEMENT AND LAW.

NOTHING IN THESE WEBSITE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL MISCONDUCT, VIOLATIONS OF LAW FOR WHICH LIABILITY CANNOT BE LIMITED, OR OTHER NONWAIVABLE LIABILITY. NOTHING ELIMINATES NONWAIVABLE PRIVACY, DATA-SECURITY, OR CONSUMER-PROTECTION RIGHTS.

WHERE A LIMITATION IS NOT PERMITTED, IT DOES NOT APPLY.

15. Suspension of Website Access

We may suspend or restrict Website access when reasonably necessary to protect users or systems, comply with law, or address a material violation of these Website Terms.

Where appropriate and reasonably practicable, we will provide notice. Restrictions on Website access do not automatically terminate a separate services agreement or eliminate obligations arising under it.

Provisions that by their nature should survive termination—including intellectual property provisions and applicable limitations, subject to their stated exceptions—will survive to the extent permitted by law.

16. Changes to These Website Terms

We may revise these Website Terms and will identify the revised version by its “Last Updated” date.

Material changes will be brought to users’ attention through a reasonably conspicuous Website notice or another appropriate method. Where acceptance is legally required, we will obtain it before applying the changed provision.

Changes do not retroactively release existing claims, alter completed transactions, or amend a separately accepted services agreement without the required agreement.

17. Applicable Law and Disputes

Applicable law, including mandatory consumer protections and conflict-of-law rules, determines the law governing a dispute.

These Website Terms do not require mandatory arbitration, waive the right to participate in a class action, or require consumers to bring claims in a forum unavailable under applicable law.

You may contact us to seek an informal resolution. Doing so is voluntary and does not prevent either party from pursuing available legal remedies or require a delay that would jeopardize a claim.

18. General Provisions

If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law. Nothing requires a court to rewrite or enforce an unlawful provision.

A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

These Website Terms constitute the agreement regarding their subject matter only where validly accepted. They do not supersede separately accepted client services agreements.

Company’s personnel identified in Section 14 are intended beneficiaries of that section, subject to its limitations and exceptions. No other third-party beneficiary rights are created unless expressly stated.

Nothing in these Website Terms limits communications with regulators, lawful reporting, or other protected rights.
